Following a first-to-file system, the country encourages businesses and individuals to file a patent application as soon as possible so that you can protect your intellectual property without any hassle. To register a patent in Indonesia, the applicant can file an application online through the Direcktorat Jenderal Hak Kekayaan Intelecktual.
Before we dive into the different types, there are some requirements you must meet first in order to obtain a patent. These include:
Industrially applicable: If the invention is not capable of being industrially applicable, it will not obtain a patent. It should be possible to implement the invention as it claims in the application.
Novelty: The invention will be considered Novel if it is different from any other technology previously disclosed at the time filing.
Utility: Whatever the invention is, it has to be practical and should be useful for the general population. In the event that it does not do what it asserts, the utility necessity will fail.
There are various inventions that are not qualified for a patent, and these include numerical calculations or models, mental ideas or cycles, imaginative manifestations, plans, standards or speculations, treatment methods, living creatures except micro-organisms, and biological processes that are essential for the production of plants or animals.
There are two types of patents in Indonesia:

Step 2
The application and all of its content must be in Indonesian language, but can also be filed in English with a translation. The translation must be provided within one month of filing the application. If any element of the application is missing then a notice may be sent to the applicant to complete the application. The application requirements are:

After the application is filed, the applicant has to request for a substantive examination. This request for substantive examination must be filed within 36 months of the filing date.
If the applicant does request a substantive examination, the application will be checked to see if there are any inaccuracies or if there are identical or similar patents already registered.
Step 4
If the application gets accepted and it does not require an Official action, it gets published in the Gazette. It is published for six months.
Step 5
During the time of publication, any objecting party can file for an opposition. Once filed, the applicant has to respond in timely fashion and if the applicant fails to do so, the application will be abandoned.
Step 6
If there is no opposition or if any objection is responded to accordingly, the patent is granted and a notice of allowance is sent to the applicant.
The entire patent process takes around 3-5 years but varies according to the legalities involved.
