Different countries have different procedures but almost every country follows a first-to-file system when it comes to patent and that allows you to obtain a patent first if you are quick in your filing. Once you get the patent first, you become the exclusive owner of your invention. To register a patent in Ukraine, the applicant can file an application through the Ukrainian Intellectual Property Institute (UKRPATENT).
The application can also be filed under PCT or Paris Convention.
Types of Patents
Types of Patents in Ukraine
There are two different types of patents in Ukraine that include utility patent and invention patent. Several requirements must be understood and followed to ensure successful patent registration. These include:
Inventive: This means that if the invention should not be obvious to the average person, it should be something unique.
Novelty: The invention should be completely new, something that no one is capable of knowing before the filing. It should not be public property or in public knowledge.
Utility/Industrially applicable: When its subject matter (invention) can be produced or used in any type of industry because of its functionality. Every industry must be able to make and use it.
There are different inventions that are not eligible for a patent, which include treatment for animals and humans, chemical formulations, mathematical algorithms or models, mental concepts or processes, artistic creations, plans or schemes, principles or theories, and plant varieties.
There are two types of patents:
- Utility Patent: Consisting of all the technical information and know-how for the invention (machine, process or system), utility patent is one of the most common types of patents that people seek to obtain.
- Design Patent: Design patents include pictures and drawings/illustrations of the invention.
How to register a Patent in Ukraine?
Step 1
Search
If you do not search for a patent beforehand, it is highly likely that you will file an inaccurate application. An extensive search will allow you to understand the problems associated with rejected applications and will also allow you to determine which type to file for. It is advisable to utilize a patent search service by an attorney or agent if you are new to it.
Searching for already registered patent will help you identify similar or identical patents and the different types of patents you can choose for your invention.
Step 2
Application
To register for a patent in Ukraine, the application and all of its content can be filed in any language however, Ukrainian translation must be submitted within two months of filing. If the application is missing any of the document, a notice will be sent to the applicant to complete the application in due time. The application requirements are:
- The application fees;
- Specifications and details of the patent;
- Drawings (when necessary, for example a design);
- Priority document (if applicable);
- Power of Attorney (foreign applicants must be represented by an attorney);
Step 3
Examination
The Ukrainian patent application undergoes the substantive examination. The substantive examination is started after the corresponding request has been filed and the official fee has been paid.
The applicant should file the request and pay the official fee within three years from filing the application. If there is any problem with the application or if the examiner needs additional documentation from the applicant, a notice is sent to the applicant.
Step 4
Publication
If the application has no objections or inaccuracies, it gets accepted and published. This is done for 90 days.
Step 5
Opposition
If any party objects against the patent, it can file an opposition during the time of publication but within 90 days of it. Any third party may file an opposition to the application by paying the corresponding fee within 6 months from the date of publication.
The Patent Office sends a copy of such an objection to the applicant, who has the right to submit a reasoned response, as well as amend the application within two months from the receipt date of the objection.
Step 6
Registration
If everything is replied to and responded accordingly, the patent gets granted and a notice of allowance is given to the applicant.
The entire patent process takes around 2-3 years on average.

How long does a patent last in Ukraine?
Patents in Ukraine are valid for 20 years from the date of filing. The official fees for publication and issuance fee must be paid within three months from the date of receipt of the grant decision for the patent. Additional 6 months, known as grace period, can be taken for late payments by paying an additional fee.
